DUGOUT AIRPODS TERMS & CONDITIONS 2020

1. INTRODUCTION

1.1  By entering the promotion, all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions.

1.2  The promotion is open to anyone who fulfils all of the following criteria:

(a)  is aged 18 or over at the date on which they enter the promotion.

(b)  is resident in a country where it is lawful: (i) for the entrant to enter the promotion, and (ii) for the promoter to promote the competition and award a prize to the entrant;

(c)  is not an employee or immediately related to an employee of the promoter, its group companies, agents or anyone professionally connected with this promotion.

1.3  Entry to the promotion opens at 07:00 GMT on 15/05/20 and closes at 17:00 GMT on 01/06/20. No entries received after the closing time will be eligible to win a prize.

1.4  No purchase is necessary to enter the promotion. However, in order to enter the promotion, you must have an internet connection and a valid email account.

2. HOW TO ENTER THE PROMOTION

2.1  To enter the promotion, provide your first name, surname, date of birth and email address.

2.2  Only one entry is permitted per person. Multiple entries from the same person will be disqualified. The Promoter accepts no responsibility for entries that, for whatever reason, it does not receive before the promotion closing time.

3. WINNERS

3.1  One winner will be selected at random from each of the prize draws on 02/06/20, by computer algorithm.

3.2  Winners will be notified by email within 5 working days of the promotion closing date and will be asked to confirm their details for delivery of the prize.

3.3  The promoter will use reasonable endeavours to contact the winner. However, if the promoter is unable to contact a winner within 10 working days of the prize draw, the promoter reserves the right to award the prize to an alternative winner selected at random.

4. PRIZES

4.1  Prizes available to be won: 1 X Pair of Apple Airpods – most recent generation with charging case.

4.2  Prizes will be posted to winners. The prizes will be delivered within 28 days from a valid acceptance of the prize. Due to ongoing C-19 disruption, delivery may take considerably longer.

4.3  All costs and expenses not included within the prizes are the responsibility of the winner(s).

4.4  Should the prize be unavailable, the promoter reserves the right to substitute an alternative prize of equal or greater value. There is no cash alternative available. Prizes are non- transferable and cannot be resold. Unless otherwise agreed in writing by the promoter, the prize will only be awarded to the winner.

4.5 Any images are an illustrative example and do not show the exact prize(s).

4.6 The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

5. CONDITIONS

5.1  The promoter may publish each winner’s name, photograph and country of residence (and county, if the winner is from the UK) on its website, Instagram, Facebook and/or Twitter account to publicise the prize-giving within a year of the closing date. Promoter may request that the winner participates in reasonable publicity in relation to the prize and, with the winner’s consent, may film all or part of any experience included as part of a prize.

5.2  No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted, and no bulk entries are permitted.

5.3  The promoter reserves the right at any time, in its absolute discretion, to:

5.3.1  verify the eligibility of any participant, including their age, place of residence, whether they are subject of any football banning order;

5.3.2  disqualify any participant:

5.3.2.1  found to be abusing or tampering with the operation of the promotion or entering using fraudulent means, or who the promoter believes to have acted in breach of these terms and conditions;

5.3.2.2  who does not give correct contact details or who makes an entry on someone else’s behalf;

5.3.2.3  posting (or who has previously posted) a post, entry or comment to their own and/or the promoter’s social media pages that is, in the promoter’s opinion, inappropriate, offensive, defamatory or upsetting to other participants, fans of the promoter or the promoter’s commercial partners relevant to the promotion, or is directly aimed at the promoter, or contrary to applicable law, and, in the case of the promoter’s social media pages, to remove any such entry or comment.

6. LIABILITY

6.1  The promotion is not in any way sponsored, endorsed or administered by, or associated with Instagram, Twitter, Facebook or Apple. Participants acknowledge that Instagram, Twitter, Facebook or Apple shall not have any liability to them in connection with the promotion.

6.2  If the promoter fails to comply with these terms and conditions, the promoter is responsible for loss or damage you suffer that is a foreseeable result of the promoter’s breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter’s breach or if they were contemplated by you and the promoter at the time that you entered the promotion.

7.2  The promoter reserves the right to extend, withdraw, alter or suspend the promotion or these terms and conditions at any time if circumstances beyond its control make this unavoidable. Any changes to the promotion will be notified to entrants as soon as possible by the promoter.

7.3  All personal data submitted in connection with the promotion will be processed by the promoter for the purposes of administering and managing the promotion and prizes (where applicable) and verifying the eligibility of each participant. The promoter is committed to protecting the privacy of all participants. Data that is collected from or about participants will be used in accordance with the promoter’s Privacy Policy, a copy of which can be found at dugout.com/privacy

7.4  The promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, are governed by English law.

7.5  You can bring legal proceedings in respect of the promotion and these terms and conditions in the English courts. If you live in Scotland and/or any Member State of the European Union, you can bring legal proceedings in respect of the promotion and these terms and conditions in either the English courts or the courts of your home country.

7.6  As a consumer, each participant will benefit from any mandatory provisions of the law of the country in which he or she is resident. Nothing in these terms and conditions, including the paragraph above, affects a participant’s rights as a consumer to rely on such mandatory provisions of local law.
