Competition Terms and Conditions

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

1.Entry ROUTES and Costs

Entries are restricted to ONE per person.

2.COMPETITION MECHANIC AND HOW TO WIN

To enter the competition, the entrant must answer the competition question on the designated competition page and successfully submit their contact details in order to be in the draw.

There will be ONE winner of the Competition.

All valid entries will be pooled from the entry routes referenced in section 1. Entry Routes and Costs. The winner will be chosen via electronic random draw no later than Friday 5th August 2022 from all entries that correctly answer the competition question on the designated competition page before the “End Time” which is referenced in section 3. Entry Period.

3. ENTRY PERIOD

Entries must be submitted during the following entry period:

From Thursday 26th May 2022 at 00.01am (the “Start Time”) until Sunday 26th July 2022 at 11.59pm (the “End Time).

Entries received before the Start Time or after the End Time will be invalid.

However if the winner cannot be contacted within 28 days from the date of the initial attempt to contact them then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.

4. ENTRY RESTRICTIONS

Open to UK residents aged [18] years or over on date of entry.
Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.
We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.
Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, will not be eligible to take part in this competition nor will anyone else at their address. If you are unable to accept the Prize of the dates offered, we reserve the right to withdraw it and award the Prize to another entrant.

You will be responsible for ensuring that you (and any of your guests) have a valid, in-date passport for travelling and are also responsible for securing and paying for any and all visas required for travel. You will also be responsible for sourcing and paying for any vaccinations or other medical provisions required for travel, for both you and your guests.

Unless expressly stated, the cost of any spending money, food, drink or any other sustenance is not included. Any additions or upgrades to flights, accommodation or otherwise are not included in the Prize and will be the sole responsibility of a prize winner, or any of their guests, to secure and pay for.

Unless expressly stated the cost of travel to and from the relevant airports are not included in the Prize, no airport transfers are included.

Where there is a vehicle hire element of the Prize, a driver must be over the age of 25 and have held a full, clean driving licence for the last 2 years. The cost of any fuel, additional insurance requirements, deposits or charges for damage etc are not included. The choice of any vehicle from a hire company is subject to the hire company’s approval and availability.

Any other excursions or activities which may be available on the holiday, but are not expressly mentioned in these Terms, are not provided for or included within the prize. The cost of any such excursions or activities are the sole responsibility of the prize winner and any guests. We accept no liability for any such activities undertaken by a prize winner or their guests whilst taking up the Prize.

It is your responsibility to ensure that you (and any of your guests) are fit, well and able to travel. We reserve the right to withdraw the prize from a prize winner and re-award the prize to another entrant where health reasons or concerns prevent a prize winner (or any of their guests) from taking up the Prize.

Cotswolds

Any other personal expenses incurred during the trip will be the responsibility of the Recipients. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

MISCELLANEOUS

Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

2.COMPETITION MECHANIC AND HOW TO WIN

How to take part:

During Magic 100% Summer on Wednesday 8th July 2022, dayparts listed below will be taking song requests and rewarding those requests chosen with the prize as mentioned in 5.0.

The Home Run with Simon Philips 4pm-7pm

In order to be in with the chance of winning a £250 Homesense and TKMaxx voucher, you must text the studio number with the word ‘MAGIC’ and the name of your chosen song or call the Magic studio line and request your song to the Production team. A maximum of 4 winners per [FS1] daypart will be chosen by random electronic draw, however if the selected winner’s song isn’t in line with the Magic Brand, a new winner will be selected.

Multiple users may enter with the same song, and if more than one entrant has requested the same song, it will only be the entrant that has been chosen by random electronic draw that will be the winner.

If your song is chosen, it will be played out during the daypart in which you have entered. You will only be deemed a winner if your name and song are chosen to be featured in the daypart you are calling/texting in to for. A member of the production team will contact you for your details if you are chosen.

There will be no more than 16 winners of the Activity/Competition.

GENERAL TERMS AND CONDITIONS

1. 2. TK Maxx & Homesense gift cards and e-gift cards supplied by this website can be purchased in £ sterling or € euro.

3. £ sterling gift cards and e-gift cards can be used as full or part payment for any products purchased in TK Maxx & Homesense UK stores or www.tkmaxx.com.

4. € euro gift cards and e-gift cards can be used as full or part payment for any products purchased in TK Maxx & Homesense stores in the Republic of Ireland. € euro gift cards and e-gift cards cannot currently be redeemed online.

5. Gift cards ordered through this site will be sent by Voucher Express to the delivery address stated on each individual order. Deliveries will be made using Royal Mail services. Orders with a combined value of £50 or less will be sent by 1st class post. All other orders will be sent by either Recorded Delivery or Special Delivery and will require a signature on arrival.

13. Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the law of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the English courts.

14. Force Majeure: Voucher Express cannot be held responsible for failure to meet its service obligations when any failure is brought about due to some cause totally beyond its reasonable control. Examples of this might include: acts of God, trade disputes; governmental intervention, fire, flood, and disruption to computer and IT infrastructure.

15. Breach of these conditions will entitle Voucher Express to seek the appropriate legal remedy available for injunction, damages or otherwise.
