Competition Terms and Conditions

These terms and conditions (the “Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Terms and the General Terms, the Terms shall prevail.

1.ENTRY ROUTES AND COSTS

Entries are restricted to one (1) entry per person in the Competition during the Prize Draw Period. Entries on behalf of another person will not be accepted.

2.COMPETITION MECHANIC AND HOW TO WIN No purchase necessary to win. To participate in this Competition, you must, during the Prize Draw Period, submit an entry (an “Entry”), as follows:

Entries are restricted to one (1) entry per person in the Competition during the Prize Draw Period. Entries on behalf of another person will not be accepted.

There will be one winner of the Competition. All valid entries will be pooled and the winner will be chosen by electronic random draw on Wednesday 4th August.

3. ENTRY PERIOD Entries must be submitted during the following entry period:

From 17th July at 00:01 (the “Start Time”) to 3rd August at 23:59 (“End Time”) (the “Prize Draw Period”).

Entries received before the Start Time or after the End Time will be invalid.

Winner Announcement. The name and the home town of the winner(s) will be announced upon request by contacting win@bauermedia.co.uk

However if the winner cannot be contacted within [14] days from the date of [the initial attempt to contact them/], then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.

The Prize Provider, at its discretion, reserves the right to require the potential winner to sign and return a declaration of eligibility and a liability/publicity release (together, the “Affidavit”). The selected entrant(s) must execute and return the Affidavit to within forty-eight (48) hours of receipt. If the selected entrant fails to return the Affidavit within the specified time, then he/she will be disqualified and will forfeit the prize, and the Promotor reserves the right to select an alternate entrant.

4. ENTRY RESTRICTIONS The Competition is open to all legal residents of the United Kingdom, aged 18 years or over at the time of entry, except for employees of Travelzoo (Europe) Limited (the “Prize Provider”), its affiliated companies or agents, advertising or promotion agencies, their families or anyone else associated with this Competition.

• Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

• We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

5. THE PRIZE One winner will receive the following prize (the “Prize”):

One (1) grand prize, consisting of: A 3-night stay in an Ocean King Room on a bed and breakfast basis at Atlantis, The Palm in Dubai. Includes return flights from London with Emirates on an Economy basis and airport transfers in Dubai. Travel is for departures on a Sunday or Monday between 9 January – 10 February, 2022, and is subject to availability (the “Grand Prize”).

The Prize is provided by Travelzoo (Europe) Limited (the “Prize Provider”). We are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.

NOTE: The Grand Prize does not include, and the Prize Provider will not pay for, any other incidental expenses on or relating to the use of the Grand Prize. The Grand Prize must be accepted as awarded and is not transferable or convertible to cash. No substitutions except at the Prize Provider’s option. The Prize Provider reserves the right to substitute a prize or a prize component with one of equal or greater value, including without limitation, but solely in the Prize Provider’s discretion, a cash award. The Grand Prize will only be awarded to the person who is the owner of the e-mail address or social media handle that submitted the Entry. All expenses and taxes related to the acceptance or use of the Grand Prize are the sole responsibility of the Grand Prize winner.

• You must be able to take the Prize on the dates above as stated, or on those dates otherwise offered by the Prize Provider, which may be subject to change and are at all times subject to availability. If you are unable to accept the Prize of the dates offered, we reserve the right to withdraw it and award the Prize to another entrant.

• You will be responsible for ensuring that you (and any of your guests) have a valid, in-date passport for travelling and are also responsible for securing and paying for any and all visas required for travel. You will also be responsible for sourcing and paying for any vaccinations or other medical provisions required for travel, for both you and your guests.

• Unless expressly stated, the cost of any spending money, food, drink or any other sustenance is not included. Any additions or upgrades to flights, accommodation or otherwise are not included in the Prize and will be the sole responsibility of a prize winner, or any of their guests, to secure and pay for.

• Unless expressly stated the cost of travel to and from the relevant airports are not included in the Prize.

• Any other excursions or activities which may be available on the holiday, but are not expressly mentioned in these Terms, are not provided for or included within the prize. The cost of any such excursions or activities are the sole responsibility of the prize winner and any guests. We accept no liability for any such activities undertaken by a prize winner or their guests whilst taking up the Prize.

• It is your responsibility to ensure that you (and any of your guests) are fit, well and able to travel. We reserve the right to withdraw the prize from a prize winner and re-award the prize to another entrant where health reasons or concerns prevent a prize winner (or any of their guests) from taking up the Prize.

• Travel Insurance will be Provided to the winner and guest and be provided by Element and the Terms and Conditions are as follows:

• The policy would not provide any cover if the winner(s) travelled against government advice or the advice of the Foreign Commonwealth Development Office (FCDO).

• A claim would not be considered if the holiday was cancelled due to FCDO advice or the government putting the UK in lockdown again as this would not fall within the Covid cover outlined under Section 17.

The Promoter and the Prize Provider reserve the right to cancel, suspend, withdraw or amend this Competition in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Prize Provider or the Promoter that interferes with the proper conduct of this Competition as contemplated by these Terms.

The Promoter and the Prize Provider reserve the right, in their sole and absolute discretion and at any time, to modify, edit or disqualify any Entry if a complaint is received with respect to the Entry, if the Entry does not comply with these Terms or for any other reason. All Entries are subject to verification at any time and for any reason. The Prize Provider reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility. Failure to provide such proof to the satisfaction of the Prize Provider in a timely manner may result in disqualification.

By entering the Competition and submitting an Entry, each entrant: (i) grants to the Prize Provider a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her submission, in whole or in part, for advertising or promoting the Competition or for any other reason; and (ii) agrees to release and hold harmless the Prize Provider and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims that relate in any way to the submission.

The Prize Provider and the Promoter will not be liable for any failure of the website or technical malfunction during the Competition or for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Competition. Nothing in these Terms shall exclude the liability of the Prize Provider and the Promoter for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.

Any disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded will be governed by and construed in accordance with English law. Except where prohibited, the parties hereby consent to exclusive jurisdiction and venue of the English courts in any action to enforce (or otherwise relating to) these Terms or relating to this Competition.

Unless agreed otherwise, the personal information you are providing when entering this Competition will be used only for the purpose of administering this Competition. All collection and use of your personal data in connection with this Competition by the Prize Provider will be done in compliance with applicable data protection legislation and in accordance with the Prize Provider’s privacy policy, available at: https://www.travelzoo.com/uk/privacy/

OTHER CONDITIONS

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

3. MISCELLANEOUS.

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
