Competition Terms and Conditions

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

1.Entry ROUTES and Costs

Online entry is free of charge.

Entries are restricted to one entry per person.

2.COMPETITION MECHANIC AND HOW TO WIN

Online Competition

The prize winner will be selected from those persons who successfully answer the question correctly.

There will be a total of one winner who will be chosen from the list of valid and correct entries.

The winner will be selected by electronic random draw after the close of the competition on 24/06/2022 at 23:59.

The winner’s first name and hometown are available on request by emailing win@bauermedia.co.uk.

3. ENTRY PERIOD

Online Competition

Start Date and End Date. From 10/06/2022 at 00:01 until 24/06/2022 at 23:59.

Entries received before the Start Date or after the End Date will be invalid

Winner Announcement: The name and the hometown of the winner will be announced on the KISS Radio Breakfast show or on request by emailing win@bauermedia.co.uk during the time the competition round sits within.

4. ENTRY RESTRICTIONS

Open to UK residents aged 18 years or over on date of entry.
Both the Nominator and the Nominee must be 18 years or over on the date of entry
Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.
We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Specific Terms.
If you or any other person at your household has won a prize valued at £500 or more on any Bauer brand in the past 6 months, you nor they are not eligible to enter or win this competition. The full list of Bauer Media brands can be found here: https://www.bauermedia.co.uk/brands

5. THE PRIZE

There will be one winner and they will win the following prize package (the “Prize”):

Entrance to 1 x KISS Sunday Pool Party of the winner’s choice from Sunday 10th July 2022 until Sunday 11th September 2022.Subject to availability.
Additional Prize T&C’s:

The Prize is provided by BH Mallorca Ltd. (the “Prize Provider”). We (Bauer Media Ltd.) are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.
Over 18’s only for both winners and guest. Valid I.D will be required.
The BH Mallorca Hotel 3-Night Stay Package includes Breakfast, Lunch and Dinner plus a limited number of free of charge alcoholic and soft drinks per day (subject to timings, and hotel T&C’s). The guests will also have access to the hotel’s Water Park and Outdoor Gym.
Economy class flights available from the following UK Airports – Birmingham, Edinburgh, Liverpool, London, Manchester or Newcastle only; Flights may be indirect and not all routing will be available; Flight itinerary will be selected at the sole discretion of the prize provider.
BH Mallorca & Bauer Media Ltd will not be held responsible for any additionally costs due to missed flights, connections, or cancellations beyond their control. Hand luggage is subject to the Airline’s luggage conditions. Hold luggage will be at an additional cost and organisation of the prize winner.
It is the responsibility of the prize winner to make sure they and all guests behave in an appropriate manor throughout the duration of the holiday, including the airport and hotel. BH Mallorca & Bauer Media Ltd will not be responsible for your holiday being withdrawn or terminated at any point due to prize winners or guests behaviour.
The prize excludes domestic ground transfers, meals and drinks (except where specified above), excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package.
The prize cannot be taken over UK Bank Holidays; The prize is valid from the date of notification and the holiday must be completed by 13/09/22, no extensions permitted. Travel must be booked and completed within that time frame. If the holiday is not completed, the holiday, and all holiday prize elements will be deemed to have been forfeited.
All elements of the prize are subject to availability; Once booked, the prize cannot be amended or cancelled; All elements of the prize must be taken at the same time; Prize is non-refundable and non-transferable; No cash alternative is available.
All travellers will require a passport valid for at least 6 months on date of travel; Any necessary visas are responsibility of winner and guests. Winner and guest(s) are solely responsible for completing all documentation (electronic or other) required in advance of travel/entry and are solely responsible for paying any associated fees
Travel insurance is subject to restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and/or their guest to meet any additional costs relating to obtaining insurance cover for any pre-existing medical condition and for any additional costs as may be specified where the winner and/or their guest are aged 70 or over. See additional prize T&C’s.
Any necessary visas or additional insurance are the responsibility of the winner and their guest; If the winner elects not to, or is unable to, use part of the prize, the winner will forfeit that part of the prize package.
Prize must be taken in accordance with government guidelines and COVID-19 rules and restrictions in place at the time of travel. The arrangement and additional costs for any COVID-19 testing or other expenses that may be incurred are the sole responsibility of the winner and guest; The Prize Provider is BH Mallorca Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at https://www.bhmallorca.com/privacy-policy/

OTHER CONDITIONS

DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

MISCELLANEOUS.

Entries which do not comply with these Specific Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Specific Terms.
Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Specific Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
